Welcome to GiftListy. These Terms of Service ("Terms") are a legal agreement between you and OjabeeLabs that govern your access to and use of the GiftListy app and website (collectively, the "Service"). By using the Service, you agree to these Terms.

1. Use of the Service

• You must be at least 16 years old or have parental consent to use the Service.
• You agree to use the Service only for lawful purposes and in accordance with these Terms.
• We may update, suspend, or discontinue any part of the Service at any time.

2. Accounts & Security

• You are responsible for maintaining the confidentiality of your account and for all activities under it.
• Please notify us immediately of any unauthorized use of your account at support@giftlisty.com.

3. Your Content

You may add occasions, items, links, and other content ("User Content"). You retain ownership of your User Content. By posting it, you grant us a non-exclusive, worldwide, royalty-free license to host and display it solely to operate the Service (e.g., show your shared list to people with the link).

4. Prohibited Conduct

• No illegal, infringing, or harmful content (including malware, hate speech, or harassment).
• No scraping, reverse engineering, or circumventing technical protections.
• No impersonation or misrepresentation of your identity.
• No abuse of the sharing or reservation features.

5. Links, Purchases & Affiliate Disclosure

The Service lets you store and share product links. We don't control third-party stores and are not responsible for their content, pricing, availability, or policies. We may use affiliate links; you pay the same price, and we may earn a commission.

6. Intellectual Property

GiftListy, including its name, logo, and software, is owned by OjabeeLabs or its licensors. Except for your User Content, all rights are reserved. You may not use our trademarks without prior written permission.

7. Privacy

Your use of the Service is also governed by our Privacy Policy, which explains what we collect and why, including optional anonymous analytics.

8. Service Changes & Availability

We may add or remove features and may suspend the Service for maintenance, security, or legal reasons. We are not liable for unavailability or data loss beyond our reasonable control.

9. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be error-free, secure, or uninterrupted.

10. Limitation of Liability

To the maximum extent permitted by law, OjabeeLabs will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising from your use of the Service.

11. Indemnity

You agree to indemnify and hold harmless OjabeeLabs from any claims, damages, or costs arising from your use of the Service or violation of these Terms.

12. Governing Law

These Terms are governed by the laws of Germany, without regard to its conflict of law provisions. If you are a consumer in the EU, mandatory consumer protection rules of your country of residence may also apply.

13. Changes to These Terms

We may update these Terms from time to time. The latest version will be posted at this URL with the effective date. Continued use of the Service after changes means you accept the updated Terms.
